Terms of service

The short version

Tack Notes is free for everything Google Keep does. Pro is an optional paid plan.
What you write is yours. You give us permission only to store it and run Tack Notes for you.
Be decent: nothing illegal, nothing harmful, no spamming people with invitations, no attacking the service.
You can leave any time and take everything with you. If we ever close Tack Notes, we’ll give you at least 60 days’ notice and your download keeps working until the end.
Cancel Pro any time, and get a full refund within 14 days. See Refunds and cancelling.

This agreement

These terms are the agreement between you and tacknotes.com (“Tack Notes”, “we”), at AA PH, Camilleri Buildings, Oratory Street, Naxxar NXR 2504, Malta. They cover the website at tacknotes.com, the web app and the Android app. By creating an account you agree to them. Our privacy policy explains how we handle your data.

Your account

You need to be 16 or older.
Give an email address that’s yours and that you can read. We use it to sign you in and to reach you about your account.
Keep your sign-in safe. We recommend turning on two-step sign-in in Settings. You’re responsible for what happens in your account, so tell us straight away if you think someone else has got in.
An account is for one person. Share notes with other people rather than sharing a sign-in.

Your notes are yours

You own everything you put in Tack Notes: your notes, lists, images and files. We claim no ownership of any of it.

So that we can run Tack Notes for you, you give us permission to store, copy, process and display your content, only to provide the service: showing it to you, syncing it across your devices, backing it up, searching it, sending reminders, running the Pro features you use, and showing it to the people you choose to share it with. This permission ends when you delete the content or your account (copies in backups are cleared within the time our privacy policy gives).

You need the right to put in Tack Notes whatever you add. For example, don’t upload other people’s photos or writing in a way that breaks their rights.

You can download everything you’ve put in Tack Notes, at any time, from Settings. That never costs anything.

When you share a note, the people you share it with can see it and, as editors, change it. When you create a read-only link, anyone who has the link can read that note. Only share what you’re happy for them to see, and turn sharing off whenever you like. People you invite who aren’t on Tack Notes get an email from us with your name and the note’s title.

What you agree not to do

Use Tack Notes for anything illegal, or to store or share illegal content. That includes any material that sexually exploits children, which we report to the authorities.
Use it to harass, threaten or harm anyone, or to share someone’s private information without the right to.
Send invitations or read-only links to people who don’t want them, or use sharing to spam or advertise.
Upload malware, or anything meant to damage or break into other people’s devices or accounts.
Try to get into accounts or data that aren’t yours, test our security without our written permission, or get around limits we set.
Overload the service, or copy it by scraping, automated sign-ups or similar.
Pretend to be someone else, or suggest Tack Notes endorses you.

If you break these rules, we may remove the content concerned, limit your account or, in serious or repeated cases, close it. Unless the law or someone’s safety stops us, we’ll tell you what we did and why, and you can reply to ask us to look again. If we close your account, we’ll give you the chance to download your notes, except where that would itself be illegal.

Reporting a problem

If you see something on Tack Notes that you believe is illegal, such as a read-only link, or if someone is sending you invitations you don’t want, email [email protected] with the link and why you think it breaks the law or these terms. We look at every report, act on it promptly and tell you what we decided. The same address is our contact point for authorities.

The free plan

Notes, lists, labels, colours, reminders, images, sharing, version history, sync, offline writing, the Android app, the Google Keep import and downloading your data are free. To keep things fair and stop abuse, there are generous limits, such as 25,000 notes and 500 labels per account. You can see them on our pricing page.

We may change what the free plan includes. If we ever take something away that you use, we’ll tell you in advance, and you’ll always be able to download your notes for free.

Pro and paying

Pro adds smart search, related notes, automatic labels, dictation, reminders from a sentence and more. It isn’t on sale yet. When it is:

Pro yearly is charged once a year and renews automatically on the same date until you cancel. We’ll remind you by email before each renewal. Cancel any time in Settings: you keep Pro until the end of the year you paid for, and it doesn’t renew.
Pro for life is a single payment for Pro for as long as we run Tack Notes and its Pro plan. It isn’t a lifetime guarantee that Tack Notes will exist; see if things end.
Prices are shown before you pay and include any VAT or sales tax we must charge where you live. Payments are handled by Stripe.
If we change the price of Pro yearly, we’ll tell you at least 30 days before your next renewal, and you can cancel before it applies.
Some Pro features come with a daily allowance, such as minutes of dictation, so that the service stays fast for everyone. The current allowances are on the pricing page.
Refunds are covered in Refunds and cancelling, including your right to cancel within 14 days.

The service itself

We work hard to keep Tack Notes running, fast and safe, and we back up your notes every night. Still, no online service can promise to be available every minute, and some things are new: the Android app is in early access and Pro features are being built. We keep improving Tack Notes, which means features may change. We recommend downloading a copy of your notes now and then, as you would with anything important.

If things end

You can leave any time. Download your notes, then delete your account in Settings. That deletes everything, as our privacy policy describes.
If we ever close Tack Notes or Pro, we’ll tell you at least 60 days before, by email and in the app, and your download will keep working until the last day. If you paid for Pro yearly, we’ll refund the unused part of your year.

Responsibility

Nothing in these terms takes away rights you have as a consumer under the law where you live, or limits our responsibility for death or injury caused by our negligence, for fraud, or for anything else the law doesn’t let us limit.

Apart from that: we’re responsible for losses you suffer because we broke these terms or weren’t reasonably careful, if those losses were foreseeable. We’re not responsible for losses that weren’t foreseeable, for business losses (Tack Notes is for personal use), or for problems caused by things outside our reasonable control. Our total responsibility to you is limited to the greater of what you paid us in the 12 months before the problem and €100.

Law, changes and contact

These terms are governed by the law of Malta, and disputes go to the courts of Malta. If you’re a consumer living elsewhere in the EU or in the UK, you also keep the protection of your own country’s laws and can bring a claim in your own courts.

If we change these terms in a way that matters, we’ll tell you at least 30 days before by email or in the app. If you don’t agree, you can download your notes and close your account before the change applies.
